what happens if a business files a frivolous law suit?

I was an independant contractor for a company and I signed a non-compete saying I can’t work in the industry for 5 years. Now they think I work for a company that is in the same industry. I don’t work for that company and their trying to sue me. Can they do that? what can I do to protect myself against a frivolous law suit?

    Someone who files a frivolous lawsuit can be ordered by the judge to pay the other party’s expenses, and can also be filed.

    But for it to be declared frivolous, it would have to be proved that they KNEW the info was false, in this case KNEW you didn’t violate the non-compete clause. Chances of proving that are slim to nil. Judy

    It is unfortunate that they are doing this to you. My guess is that there is some basis for it, so you need to get to the bottom of it. If you have been served papers of some sort, then you need to get a lawyer to make it go away.

    My advice is to take it seriously. Do not ignore it or you may have a judgement levied against you for not showing up to court if it proceeds that far.

    If you cannot call them and discuss it, you will need to get yourself a lawyer as soon as you are served. If you can afford it, you should do so now as he may be able to address their concerns before it goes that far.
